NRJ Group: The €10.3 Million Won Against Fun Radio Will Wait Until End of Year
In a press release dated September 29, 2026, NRJ Group announces that the Paris Court of Appeal has postponed the ruling it was due to deliver on September 25 in the Fun Radio case. At stake: the €10.3 million in damages obtained at first instance against M6 and the operator of Fun Radio, which the group has still not recorded in its accounts.
A Ruling Expected on September 25, Postponed Until End of Year
The Paris Court of Appeal was due to deliver its ruling on September 25, 2026, following oral arguments held on February 5.
Citing an excessive number of cases to process, it has postponed its deliberation to a date which, according to NRJ Group, should occur by the end of the year.
Ten Years of Proceedings Over Inflated Listening Figures
The group states it discovered in May 2016 messages broadcast in Fun Radio's breakfast show encouraging listeners to over-report their listening to the station to Médiamétrie researchers. This campaign had allegedly been in place since at least September 2015 and had distorted the audience results of competing radio stations, including those of NRJ. In December 2016, the group, its radio subsidiaries and its advertising agencies sued Fun Radio, RTL and IP France (which became M6 Publicité) before the Paris Commercial Court for unfair competition.
On January 23, 2023, this court ordered Radio Chic Operating Company, which operates Fun Radio, and Métropole Télévision, succeeding Ediradio (RTL), to pay €10.345 million in damages jointly and severally, plus interest at the legal rate and €500,000 in legal costs. Both companies appealed on January 26, 2023 to obtain its annulment or modification; on July 25, 2023, NRJ Group filed an incidental appeal to obtain the full amount it was claiming.
A Receivable That NRJ Has Never Recorded
Pending the decision, NRJ Group has recognized no income on this account. The €10.8 million at stake, before tax and excluding interest at the legal rate, represents approximately €0.14 per share, or 2.3% of the group's market capitalization and 13% of its 2025 net profit.
For its part, M6 provides no details on individual disputes in its universal registration document. Its consolidated provisions for litigation amounted to €19.4 million at the end of 2025, compared to €15.7 million a year earlier.
